How Long?

My partner and I moved out of out rental property on the 7th of July. We still haven't recieved the bond back as the landlord hasn't sent in the bond refund even after us calling her etc, she reckons she has been a bit busy lately to get around to it. The realestate agent has been through and checked the house etc but the landlord wants to do it herself now. We have been really patient, but I think it's a bit off when we have been waiting two months for the refund now.

The question I have is How long is a reasonable time to wait before contacting the "higher authorities"?

That does seem excessive. She has had plenty of time. Fair enough you start getting pushy with her! That is a lot of money.

When you say real estate agent, do you actually mean rental property manager? Surely they could mediate a bit and get her to do it?

The real estate agent is the one who rented us the property, we have never met the landlord as she lives in another part of Auckland or something. So we have dealt with the real estate agent the whole time. (she isn't the property manager on this property, just finds tenants) During the year that we were there, we never had any inspections etc and when we were thinking of moving out, we contacted the real estate agent and sussed it out with her, she came and inspected and was please with the state of the house etc and understood why we wanted to move. (unhealthy living conditions - everytime it rained it soaked through the concrete deck of the flat upstairs and 'rained' in our lounge, also black mould grew on every concrete surface - most of the house) The Landlord reckons she didn't know we had moved out and hadn't even noticed that our rent payments had stopped. I have told her that in order to get our new place we had to borrow money for another bond and letting fee etc and now we really need to pay the money back.

Have moved into another rental and had to borrow $1250 off my partners folks to get in with the understanding that it would be a loan for a couple of weeks at the most. Apparently couldn't get it transferred because for a week we had 2 properties. (took us a week to dismantle our fish tanks etc and re-setup and move our houseload of stuff aswell as work)

Call the tenancy people and give them the full story. I think you have waited plenty long enough already.

We had a similar problem with our old landlords when we moved - we couldn't pay the bond on the new place until they had signed off from the old place. The new landlords were extremely patient but it became very embarrassing for us because we had no way of paying the new bond until the old one was refunded.

In this case you would only be able to claim interest if you were paying interest on your loan, which sounds like it isn't the case. You just need your bond refund ASAP.

The bond is not held by the renting agent.

You're right - the bond is not held by the renting agent, it is held by Tenancy Services. But if your bond is still being held against your old tenancy (because the old landlord has not signed it off) then it is not available to be used for the new tenancy.

The tenant therefore has a period of time when they have to cover both bonds. When that period of time stretches to two months (as in Aaron's case) without reason, then it is putting an unfair financial strain on the tenant.

When you paid your bond it should have been lodged by the agent with Tenancy Services (if they are renting out the property on behalf of the landlord) and they will have a copy of the bond lodgement receipt. I believe you also should have one. Normally this needs to be signed by both parties before it can be refunded.

However with one of our tenants the signed form went missing and the tenant applied himself for the refund. We received a letter saying that unless we objected within 3 weeks they would pay.

If you don't have a copy of the bond lodgement get in touch with the letting agent and ask where it is.

My understanding is that an inspection should be done immediately on the premises being vacated with both parties present. This is something we always do.

Righty, rang up the Tenancy Tribunal and they said I only have to fill out the refund form and send it into them, they send a letter out to the landlord and if there is no reply in 15 working days we get paid out.

Just a pain in the behind that we have to go through all of this.

On a positive note, my full red CT pair of fighters spawned today :D
