disgustipated
i don't see why it wouldn't still be in effect. nothing would change? note they only restrict the buying, selling, and breeding of BTS up here, they do not restrict the keeping of BTS. ZombieFish
no- the existing bylaws are not defunct now that the local councils are not functional. that would have caused havoc. the bylaws are under review - and changes are/will be made to reflect the good of the local community. alanmin4304
If you had them before the bylaw came in you can keep them but you cannot breed them, sell them, etc. If you bought them after the bylaw came in they are illegal. sneaky2
its all a bunch of bollocks .how do you stop them breeding when most people cant sex them? if they do breed do you kill the babies? just pushes them undeground in auckland, wich is all they care about anyway. out of sight out of mind. sneaky2
anyone know when the bylaw came in? must of been 5 or 7 years ago ish.
alanmin4304
It may or may not be bollocks but it is the law. You would be unwise to advertise on a public forum that you have illegal animals if that is the case. It has been mentioned that they are not permitted in the Auckland region many times in the past on this site.
disgustipated
big difference between a law and a bylaw. even religious groups can pass a bylaw.
livingart
no difference really in this case Municipal by-laws are public regulatory laws which apply in a certain area. The main difference between a by-law and a law passed by a national/federal or regional/state body is that a bylaw is made by a non-sovereign body, which derives its authority from another governing body, and can only be made on a limited range of matters. A local council or municipal government gets its power to pass laws through a law of the national or regional government which specifies what things the town or city may regulate through bylaws. It is therefore a form of delegated legislation. Within its jurisdiction and specific to those areas mandated by the higher body, a municipal by-law is no different than any other law of the land, and can be enforced with penalties, challenged in court and must comply with other laws of the land, such as the country's constitution. Municipal bylaws are often enforcable through the public justice system, and offenders can be charged with a criminal offence for breach of a bylaw. Common bylaws include vehicle parking and stopping regulations, animal control, building and construction, licensing, noise, zoning and business regulation, and management of public recreation areas. http://en.wikipedia.org/wiki/By-law

alanmin4304
Local authorities are empowered to make bylaws by the Local Government Act. Many are now doing away with a lot of the bylaws and using the RMA as the penalties are far greater. There is no future in prosecuting someone and getting a twenty dollar fine and then the bill comes in from the lawyers at a couple of grand. They are also using it instead of the nuisance section of the Health Act for the same reason. Christchurch City has got rid of many of their bylaws now. alanmin4304
You can stop them breeding by keeping the males and females seperated---funny that.
